Probation, which is granted by the judge, is a sentence that allows the offender to live in the community under the supervision of a probation officer. Theoretically, this decision is made after careful study of the offender's background, behavior, and potential for success. It is based on the philosophy that the rehabilitation of some offenders might be hampered by incarceration and will be supported and enouraged by supervised freedom.

The 1st Division of the 52nd District Court has a Chief Probation Officer as well as six additional probation officers that each carry a caseload of 400 to 500 people. They are responsible for conducting Pre-sentence Investigations and Alcohol Assessments along with Probation Violation Hearings. The clerical support staff is responsible for the processing and creation of the files that are used by each officer. Finally, each probation officer is assigned a special program that requires working with the judges and key individuals within the community.
